All Users

Betfair acts as an intermediary between a 'Buyer' and 'Seller' and not as an agent with the sole intention of initiating transactions which result in the mutual satisfaction of both parties. Nothing in this Agreement and no action taken by the parties pursuant to this Agreement shall constitute, or be deemed to constitute, the parties as an agency, partnership, association, joint venture or other co-operative entity.

Those who choose to access this Web Site are responsible for compliance with applicable local laws. You are solely responsible for compliance with all applicable export/import laws, regulations, taxes, licenses and fees.

In order to protect the legal rights and recourse of both Buyers and Sellers, all users of the site affirm that they are legal adults, able to enter into contracts and at least 18 years of age. Persons not meeting this requirement are not allowed to post bid requests or bids AND any bids that may be posted by them shall be null and void.

The Site

The site itself is provided without warranty of any kind subject to the specific exclusions and limitations on liability set out in detail below. There are no guarantees that it will be available at any given time, and no guarantees that use of the site will not be subject to interruptions. All direct or indirect risk related to use of the site is borne entirely by you, the user.

Your Conduct

While using this site, you agree not to:

  • Restrict or inhibit anybody else from using the site.
  • Post any unlawful, fraudulent, threatening, abusive, defamatory, obscene or otherwise objectionable content.
  • Post or transmit any information or software that contains a virus or other harmful/disruptive component.
  • Post or transmit materials in violation of another party's copyright or intellectual property rights.
  • Post or transmit information in violation of site rules and/or legal agreements.
  • All projects posted, managed, processed and/or completed via the Portal with access to Betfair Data must be developed in conjunction with the Betfair API and any failure to comply with this clause shall constitute an irremediable material breach.

Betfair reserves the right to change or delete user public content and/or private communications sent through this site. Additionally, it may refuse service and/or block any user who does not adhere to these guidelines, or for any other reason for which Betfair deems prudent. Additionally, legal action may be pursued at our discretion. Betfair may take this action without prior notice or explanation to the user.

Exclusions and limitations of Liability

Save as provided by statute and to the fullest extent permitted by law, the following provisions set out the entire liability of Betfair (including any liability for the acts and omissions of its employees, agents and sub-contractors) to the user of the site and services to which these terms relate (?User?) whether in contract, tort, statute, equity or otherwise:
  1. The User acknowledges and agrees that (except as expressly provided in this Agreement) the site and services are provided "AS IS" without warranties of any kind (whether express or implied);
  2. All conditions, warranties, terms and undertakings (whether express or implied, statutory or otherwise relating to the delivery, performance, quality, uninterrupted use, fitness for purpose, occurrence or reliability of the site and services are hereby excluded to the fullest extent permitted by law; and
  3. Betfair shall not be liable to the User for loss of profit (whether direct or indirect), loss of contracts or goodwill, lost advertising, loss of data or any type of special, indirect, consequential or economic loss (including loss or damage suffered by the User as a result of an action brought by a third party) even if such loss was reasonably foreseeable or Betfair had been advised of the possibility of the User incurring such loss.

No exclusion or limitation set out in this Agreement shall apply in the case of:

  1. fraud or fraudulent concealment;
  2. death or personal injury resulting from the negligence of either party or any of its employees, agents or sub-contractors; and/or
  3. any breach of the obligations implied by (as appropriate) section 12 of the Sale of Goods Act 1979, section 2 of the Supply of Goods and Services Act 1982 or section 8 of the Supply of Goods (Implied Terms) Act 1973.

The time limit within which the User must institute suit against Betfair to recover on any claim shall be 1 year from the date the User should reasonably have become aware or becomes aware of the relevant breach that would form the subject of the claim.
